Chapter 17 Recovery

8 They are trying to get away with interpreting the language in the Lanterman Act as relative to one’s chronological age as if it is obvious that a three year old should not be expected to live independently or be economically self-sufficient, thereby reducing the qualifying areas of major life activity from 7 to 5.

10 “Free” is highly unlikely in an autism case. “Appropriate” is a basic floor of opportunity, which means expectations are minimal. “Public” is included to ensure that children are not kept in their homes or institutions; however, segregation in a public place is the norm. “Education” is grade-level curriculum which generally starts at Kindergarten, however, if your District offers regular education preschool, then it also must have a special education preschool component.

 

11 Educational Benefit is interpreted differently in case law. Progress is used as a measure but since it is not defined, that means that as long as a child makes one day worth of progress in a year’s time, the District may meet its legal burden.

 

12 Taping notice must be in writing and submitted 24 hours prior to meeting.

Each party makes an opening statement, calls witnesses, offers other relevant evidence, and makes closing arguments. The ALJs are neutral fact-finders who are fully independent of the agencies whose attorneys appear before them.
